What Went Wrong? Our Legal Take: 12-Year-Old Injured in Townhomes Shooting, College Park

“[A] 12-year-old child was struck in the arm by a stray bullet…at the Sierra Townhomes” in College Park, Tuesday evening, December 8, 2015.

According to Athens Banner-Herald, the child was attending a vigil when gunfire erupted. The young boy was apparently “struck in the arm by a stray bullet.”

Police have not yet made an arrest in the shooting, presumably leaving many College Park families concerned for their safety. In 2010, College Park was named by the FBI as number one in metro Atlanta for violent crime, property crime and total crime. In 2014, Home Security Shield and Movoto both listed College Park as the number one “most dangerous” place to live in Georgia.

Security Negligence? Our Legal Take: 4-Year-Old Shot, Injured at Highlands of East Atlanta Apartment Complex

Apartment residents and community leaders are calling for an end to apartment gun violence following the shooting of a four-year-old boy outside the Highlands of East Atlanta apartment complex Saturday, December 5, 2015.

According to CBS 46 News, the young child “was outside riding a Big Wheel when he was shot.” The gunman was apparently aiming for two “intended targets” when the little boy was struck in the crossfire. The young victim was transported to the hospital in critical condition and, thankfully, “later upgraded to stable condition.”

Gunfire is apparently not uncommon in the area surrounding the apartment complex. A resident who was reportedly outside with his own children when the young boy was struck told media “he hears gunshots at least every other day.”

“These are just not bang, pow,” the resident explained, “No, no it’s dozens of shots.” The resident is now calling on other community parents to “step forward as fathers and mothers and…try to stop these shootings.”

A local reverend is also looking to local apartment complexes to do their part and “invest more money in security.”  “They have to come up with it in the budget in order to just keep the people safe that live here,” the reverend told media.

A man was reportedly shot and killed outside the Kingstown Apartments in Decatur Monday morning, June 8, 2015.

According to 11 Alive News, investigators believe the shooting occurred near the 1625 apartment building on Line Street, shortly after midnight. The victim apparently attempted to escape in his SUV, but crashed into another vehicle.  Tragically, he succumbed to injuries at the scene.

Police are still searching for suspects and a motive.

As police continue to search for suspects, The Murray Law Firm is questioning whether a fatal apartment security lapse may also hold responsibility in this tragedy.

How did the gunman gain entry to the property? What access controls and security measures, such as gated entry, fencing, security patrols, bright lighting, and surveillance cameras, were in place to protect residents and deter crime? Did any such precautions fail?

By law, apartment owners are required to protect all residents legally on the premises from any foreseeable harm.  Should the Kingstown Apartments owner and management company have failed in this legal duty, the victim’s family may elect to pursue a legal claim for his wrongful death.  Under such a claim, the family may be entitled to an award of damages that could include, among other items, substantial monetary compensation for: pain and suffering; loss of wages and future earning capacity; loss of consortium; and, mental anguish. If the facts of this matter warrant such a negligent security claim, it would not only be an avenue of justice for the victim’s family, but would also demand that the Kingstown complex re-evaluate security measures.  It would also serve as a grave warning to other Atlanta-area apartment owners to make resident safety their first priority.
